TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Digipanda (“we,” “us,” or “our”) governing your access to and use of the Rapstar mobile application (the “App”).

By downloading, installing, or using Rapstar, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the App.

We reserve the right to update these Terms at any time. Continued use of the App following any changes constitutes acceptance of the revised Terms.

2. Description of Service

Rapstar is a mobile card-swipe game in which players judge rap battle content by swiping cards. Players accumulate scores based on their in-game decisions and compete on a global leaderboard.

The App is provided “as is” for entertainment purposes. We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Rapstar. If you are under 18, you represent that you have obtained parental or guardian consent to use the App and agree to these Terms.

By using Rapstar, you represent and warrant that you meet the eligibility requirements stated above. If we learn that a user does not meet these requirements, we may terminate their access without notice.

4. Display Names and User Identity

When you participate in the leaderboard, you choose a display name. You are solely responsible for the display name you select. Your display name:

  • Must not impersonate any person or entity.
  • Must not include offensive, hateful, or discriminatory language.
  • Must not include personally identifiable information such as your real name, email address, or phone number.
  • Must not violate the intellectual property rights of others.
  • Must not include profanity, slurs, or content inappropriate for a general audience.

We reserve the right to remove or modify any display name that violates these guidelines, at our sole discretion and without prior notice.

5. Leaderboard and Game Data

By participating in the Rapstar leaderboard, you acknowledge and agree that:

  • Your display name and score are publicly visible to all users of the App.
  • Leaderboard rankings are determined solely by legitimate in-game activity.
  • Scores generated through exploits, cheats, hacks, or any unauthorized means will be removed and the associated account may be permanently banned.
  • We may reset, adjust, or remove leaderboard entries at any time if we determine they were achieved through illegitimate means.
  • We do not offer monetary prizes or rewards for leaderboard positions unless explicitly stated in a separate promotion.

6. Prohibited Conduct

You agree not to engage in any of the following:

  • Using cheats, bots, scripts, exploits, hacks, or any unauthorized third-party software to manipulate game data or scores.
  • Attempting to access, modify, or interfere with the App's servers, infrastructure, or backend systems.
  • Reverse engineering, decompiling, or disassembling any part of the App.
  • Circumventing any security measures or access controls within the App.
  • Collecting, scraping, or harvesting data from the App or its leaderboard without our prior written consent.
  • Using the App for any illegal purpose or in violation of any applicable local, national, or international law.
  • Impersonating Digipanda, our employees, or other users.
  • Attempting to gain unauthorized access to other users' data.

Violation of these prohibitions may result in immediate termination of your access, and we reserve the right to pursue legal action where appropriate.

7. Intellectual Property

All content within Rapstar — including but not limited to game mechanics, graphics, audio, code, text, user interface elements, and the Rapstar name and logo — is owned by or licensed to Digipanda and is protected by applicable intellectual property laws.

Your use of the App does not grant you any ownership rights or licenses to our intellectual property beyond what is strictly necessary to use the App as intended.

You may not copy, reproduce, distribute, create derivative works from, or publicly display any content from the App without our prior written permission.

8. Privacy

Your use of Rapstar is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Digipanda expressly disclaims all warranties, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose.
  • Warranties that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Warranties regarding the accuracy, completeness, or reliability of any content within the App.

We do not warrant that the App will be compatible with your device or that any defects in the App will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Digipanda, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App. This includes, without limitation:

  • Loss of data, including game progress or leaderboard scores.
  • Loss of revenue, profits, or business opportunities.
  • Any personal injury or property damage resulting from your access to the App.

In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, our liability shall be limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Digipanda and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or inability to use the App.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of any third party.

12. Termination

We reserve the right to suspend or terminate your access to Rapstar at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, cheating, or conduct that we deem harmful to the App or its users.

Upon termination, your right to use the App immediately ceases, and we may delete your leaderboard data. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

14. App Store Terms

If you download Rapstar from Apple's App Store, you acknowledge that:

  • These Terms are between you and Digipanda only, not with Apple.
  • Apple has no obligation to provide maintenance or support services for the App.
  • Apple is not responsible for addressing any claims relating to the App or your use of it.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

Similar terms apply if you download from the Google Play Store with respect to Google.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions will continue in full force and effect.

16. Changes to These Terms

We may revise these Terms from time to time. The revised version will be effective upon posting within the App or on our website, with the “Last Updated” date reflecting the date of the most recent revision.

We encourage you to review these Terms periodically. Your continued use of Rapstar following the posting of revised Terms means you accept and agree to the changes.
